A Title IX lawsuit will be heard later this year by the 4th US Circuit Court of Appeals, which hears appeals from the nine federal district courts in Maryland, Virginia, West Virginia, North Carolina, and South Carolina and from federal administrative agencies.
The plaintiffs claim that North Carolina’s Charlotte-Mecklenburg Schools failed to address an ongoing hostile environment that encouraged rape culture and discouraged sexual assault reporting and alleges that in failing to address a hostile environment, the school and its resource officer contributed to an alleged rape on school grounds.
The plaintiff is appealing a 2023 US District Court jury’s decision that found the student had been sexually assaulted, but not that the school district and police department had acted with deliberate indifference. For additional information, click here and here.
