On February 25, 2025, the American Federation of Teachers (AFT) filed suit against the U.S. Department of Education (USDE) alleging that the agency’s recent guidance barring schools from considering race in any of their programs and policies or undertaking diversity, equity, and inclusion efforts is unconstitutional.
In its suit, the AFT avers that the agency’s guidance is vague, overly broad, “radically upends” current law, and forces colleges to either chill free speech or risk prosecution and the loss of funds. The suit asks a federal court to declare the guidance unconstitutional and to block the USDE from enforcing it.
AFT is joined by its Maryland chapter and the American Sociological Association as plaintiffs in the case.
