According to U.S. Secretary of Education Miguel Cardona, the long-awaited Title IX athletics final rule is being delayed due to the high volume of feedback received during the public comment period.
Recently, a broader Title IX rule was released to protect victims of sexual violence. That broader proposal was submitted nine months prior to the athletics rule. Such is the reason that both rules were not submitted simultaneously.
However, the USDE has yet to send the athletics rule to the Office of Management and Budget (OMB) for review. That step, required by federal regulatory procedure, can take up to 120 days before regulations are published in the Federal Register.
